The distribution of the levy for private copying

In accordance with the Copyright Laws, the levy is distributed, pro rate to a third party, to each of the following categories:

  • the authors/composers
  • the performing artists
  • the producers of phonograms and audiovisual works

The amounts that the General Assembly of Auvibel makes available to the Boards are divided up as follows:

In the first place, the total amount to be paid out to the Boards by the General Assembly will be divided between audio and video.

Thereafter, the legal formula will be applied to distribute the two amounts among the Boards concerned - i.e., 1/3 for the authors/composers, 1/3 for the producers and 1/3 for the performing artists.

Then each college sets up its own distribution arrangement. This must be given official approval from the Minister. The calculation of the distribution between the members of the Boards will then be done in accordance with the regulations approved by the Minister.
