When and how must the remuneration be declared to Auvibel

The levy for private copying is due from the moment that the device or medium is put on the market in Belgium. The liable party is obliged to send a declaration to Auvibel each month, before the 20th day following the month to which the declaration refers (via mail, post or fax). This obligation also applies to months for which the remuneration-payer has nothing to declare. If the liable party has nothing to declare, it is sufficient to send us a message mentioning the name of the company, company registration number, reference month and the word "NIL".

 

From 2010-02-01

The monthly declaration must mention:

  • For the devices: the quantity, the properties and the capacity.
  • For the media: the quantity, the properties and the capacity.

Further rules for payment

Auvibel draws up an invoice based on the declaration that has been sent in.

Manufacturers and wholesalers pay the remuneration for private copying within 60 days.

Retailers pay the remuneration for private copying within 15 days.

 

Up to and including 2010-01-31

The monthly declaration must mention:

  • For the devices: the quantity and properties and the basic price on which the levy is calculated.
  • For the media: the quantity and properties and the recording time and capacity.

Attention

For manufacturers and wholesalers the basic price for calculating the levy is
their sale price! They declare according to the date of sale!
The date when the levy becomes due is the date of sale, for both devices and media.

For retailers, the basic price for calculating the levy is their purchase price multiplied
by the coefficent 1.2! They declare according to the date of purchase! The date when the levy is due is the date of purchase.
